Nguyen Manh Dzung is a qualified Vietnamese lawyer. He has over 24 years of experience in the settlement of maritime, commercial and investment disputes through international litigation and arbitration in Vietnam and other jurisdictions such as Singapore, Hong Kong, United Kingdom and France. 

Dzung specialises in all types of international dispute resolution in Vietnam, including:

  • Settlement negotiations,
  • Litigation before economic and civil courts of major cities of Vietnam,
  • International arbitrations conducted under UNCITRAL, ICC, JCAA, SIAC Rules and Arbitration Rules of Vietnam International Arbitration Center (VIAC) in Vietnam.

Dzung has an outstanding record of experience in the Vietnamese legal landscape and has influenced the sector in various ways, such as:

  • Is an active member of the Drafting Committees on Commerical Arbitration Legislation – involved closely with the legislative process of the 2010 Law on Commercial Arbitration,
  • Subsequently commented on the 2010 Law on Commercial Arbitration various guiding bye-laws and regulations for the Supreme People’s Court of Vietnam and the Ministry of Justice of Vietnam, 
  • Has been appointed as an ADR expert to the Supreme People’s Court in project (sponsored by UNDP) to improve court annexed mediation.
  • Officially retained by World Bank to act as a local consultant in advising the Supreme People’s Court, to amend the current Civil Procedure Code for promotion of ADR in general but particularly in arbitration, including the recognition and enforcement regime.

Graduating Hanoi University of Law in 1990, Dzung obtained his Master of Law Degree at Queen Mary, University of London in 2008, which focused on international and commercial dispute resolution. 

Furthermore, Dzung’s outstanding record of expertise has led him to be appointed as visiting lecturer on arbitration and mediation at the Diplomatic Academy of the Ministry of Foreign Affairs, and Judicial Academy of the Ministry of Justice of Vietnam.

 

International Arbitration:

  • Acted as co-legal counsel to a BVI Company in relation to an investment dispute and parallel proceedings that involved a Vietnamese company and a Vietnamese state authority,
  • Acted as co-legal counsel for a Vietnamese Textile Corporation in a joint venture dispute with an investor before ICC Arbitration with a seat in Singapore,
  • Acted as co-counsel to a Japanese company in several court proceedings against a Vietnamese state authority, in relation to a number of ICC arbitrations arising from a major public infrastructure project.

Domestic Arbitration:

  • Represented a group of shareholders against a large Vietnamese joint stock commercial bank in a hybrid dispute resolution process,
  • Represented a notable French invested retailer in a number of VIAC arbitrations on contractual disputes relating to the development of supermarkets in Vietnam,
  • Acted for a renowned Korean construction corporation in two VIAC arbitrations against a large State-owned commercial bank regarding two construction contracts,
  • Stood as legal counsel to a foreign invested company in a VIAC arbitration on a construction project against a Malaysian subcontractor,
  • Acted as legal counsel to a foreign invested company, who was the subcontractor in a major construction project, against a Chinese contractor in the Court of Hanoi City,
  • Represented an international investment fund in a VIAC arbitration against a local joint stock company regarding a shareholder dispute,
  • Acted as legal counsel to global trading companies in regards to sales contract disputes before the VIAC in Hanoi,
  • Stood as co-legal counsel to a French invested company in terms of a service contract dispute before the VIAC in Hanoi,
  • Acted as co-legal counsel to several international trading groups in regards to the recognition and enforcement of eleven foreign arbitral awards that held a value of millions of dollars,
  • Acted as legal counsel to a BVI Company operating in Hong Kong, in relation to the recognition and enforcement of an SIAC award worth a significant amount of money,
  • Stood as legal counsel to several Singapore companies in terms of the recognition and enforcement of a number of institutional and ad-hoc arbitral awards,
  • Stood as legal counsel to a Korean and US partnership in regards to the recognition and enforcement of an SIAC arbitral award,
  • Acted as legal counsel to a Russian company in relation to the recognition and enforcement of an ICAC arbitral award,
  • Acted as a co-arbitrator in arbitration proceedings conducted under VIAC Rules, in regards to disputes that arose from a service contract, an international sale of goods contract and a loan agreement.
