Dzungsrt & Associates is pleased to share our victory in a matter of the recognition and enforcement of a foreign arbitral award in Vietnam, arising from a cross-border construction dispute. In this case, the main contractor, in its capacity as the Claimant in the arbitration proceedings in accordance with the ICC Rules, is the Award Creditor. Meanwhile, the Respondent, being the Award Debtor, is a subsidiary of a large Vietnamese state-owned enterprise.
Following a favorable award, we were appointed to represent the client before the Vietnamese courts to seek recognition and enforcement of the Award. We directly developed and implemented the legal strategy for the entire proceedings in Vietnam, successfully persuading the Vietnamese court to recognize and enforce the Award.
The case was enrolled by the Ho Chi Minh City People’s Court in July 2024. In February 2026, the First-instance Court issued a decision recognizing and enforcing the Award totaling USD 17 million USD with interest at 5% per year, thereby securing our client’s lawful rights and interests.
